WhenApplicantsubmittedhissecurityclearanceapplication(SCA)inMarch2013,he p answered notoquestionsthataskedwhether,duringthepastsevenyears,hedefaultedonanytype \  ofloanorhadbillsordebtsturnedovertoacollectionagency,andwhetherhewascurrently120 H! daysdelinquentonanydebt.HedidnotdiscloseintheSCAthedebtsallegedintheSOR.Inhis 4"  responsetotheSOR,hedidnotsubmitanydocumentationthatthedebtshavebeenpaid,  #p! compromised,forgiven,disputed,orotherwiseresolved.Hedidnotsubmitaresponseto  $\" DepartmentCounselsFileofRelevantMaterial(FORM). $H #   TheJudgesAnalysis  & "%     Applicantisnotlegallyresponsibleforthecreditcarddebtinwhichhewaslistedasan (#' authorizeduser.Thisallegeddebtwasnotestablishedbytheevidence.TheJudgefoundfor )$( Applicantonthatdebt. *%)   l+&*   Applicantsadmissionsandhiscreditreportestablishtheothertwocreditcarddebts.These   debtsarerecent,butarguablyinfrequent.Applicantprovidednoinformationaboutthe  circumstancesinwhichthedebtswereincurredandsubmittednoevidenceshowingthedebtswere  paidorotherwiseresolved.Hehasnotdisputedanyoftheallegeddebts. t   Applicantsexperienceandlevelofeducationarerelevantindeterminingwhetherafailure L  todiscloserelevantinformationonaSCAwasdeliberate.Applicantmadepaymentsontwocredit 8  cardsaftersubmittinghisSCA,whichcontradicthisclaimthathethoughtthedebtswerepaidwhen $ t hesubmittedthatdocument.Theamountofthedebts,thelengthyperiodduringwhichthedebts  ` wereunresolved,andhisimplausibleandunconvincingexplanationfornotdisclosingtheminhis  L  SCAindicateanintentionalfalsification.Hisfalsificationwasrecent,notminor,anddidnothappen  8  underuniquecircumstances. $      Discussion        Inhisappealbrief,Applicantarguesthatthedebtswereincurredwithouthisknowledge.   Specifically,hestatedhisexwifeincurredthemaftertheirdivorce.Healsoclaimedthathe p providedthisinformationtoasecurityofficer(whoisnottheonethathediscussedinhisSOR \ answer).SuchinformationwasnotpreviouslypresentedtotheJudgeand,therefore,constitutesnew H evidencethattheAppealBoardcanneitherreceivenorconsider.DirectiveE3.1.29. 4   ApplicantalsopresentsargumentsconcerningtheGuidelineBallegations.Sincethe  \ GuidelineBallegationswerewithdrawn,weneednotaddresshisargumentsregardingthose H allegations.TheremainderofhisappealbriefamountstoadisagreementwiththeJudgesweighing 4 oftheevidence,whichisnotsufficienttoshowthattheJudgeweighedtheevidenceinamannerthat   wasarbitrary,capricious,orcontrarytolaw.See,e.g.,ISCRCaseNo.1406634at2(App.Bd.Apr.   28,2016).     `   TheJudgeexaminedtherelevantevidenceandarticulatedasatisfactoryexplanationforthe  decision.Thedecisionissustainableonthisrecord.
